COMMERCIAL USE LICENSE & TERMS OF USE

Thank you for purchasing this digital product!

Your purchase includes a limited, non-exclusive, non-transferable commercial-use license allowing you to use these materials to generate revenue through your own creative business, subject to the terms outlined below.

This license permits you to sell the creative experience, not the materials themselves.

1. PERMITTED COMMERCIAL USE

YOU MAY:

  • Use these materials to host paid events, classes, workshops, paint parties, murder mystery events, and other in-person creative experiences through your licensed business.

  • Use the included concepts, scripts, instructions, painting references, tracers, host materials, templates, and other resources to facilitate those events.

  • Print necessary materials for guests participating in events hosted by your licensed business.

  • Allow employees or instructors working on behalf of your licensed business to use the materials when conducting authorized events.

  • Use the materials repeatedly for unlimited events within the scope of your license.

  • Advertise, promote, and charge admission for events using these materials.

  • Host events at approved off-site venues as outlined in the business licensing section below.

2. PROHIBITED USE

YOU MAY NOT:

  • Resell, redistribute, share, sublicense, or give away any portion of the digital files.

  • Upload the files to Facebook groups, membership sites, shared drives, online communities, websites, marketplaces, or other file-sharing platforms accessible to unauthorized individuals.

  • Sell or distribute printed or digital copies of the included materials, except for guest handouts specifically required to conduct authorized events.

  • Copy, reproduce, or republish the materials for another business, independently operating instructor, studio, franchise location, or organization.

  • Modify, repackage, rebrand, or alter the materials for resale or redistribution.

  • Remove Rare Bird Art Studio, The Creative Easel, or other copyright and ownership information and claim the materials as your own.

  • Use the materials to create a competing digital product, course, membership, downloadable package, mystery kit, event kit, template, or other product for sale.

  • Share purchased materials with another studio owner, independently operating instructor, friend, colleague, or business.

  • Extend your license to additional permanent studio or franchise locations without obtaining the required licenses.

3. BUSINESS LOCATION & MOBILE BUSINESS LICENSING

Commercial-use licenses are issued according to the structure of the purchasing business.

A. Independent Mobile Businesses

An independently operated mobile creative business without a permanent studio or storefront may use the purchased materials to host unlimited paid events at multiple temporary venues.

These venues may include:

  • Breweries and restaurants

  • Community centers

  • Private residences

  • Schools and event facilities

  • Other temporary event locations

One commercial-use license covers one independently operated mobile business, regardless of the number of temporary venues used.

Employees and instructors may conduct events on behalf of the licensed mobile business.

Individuals operating their own separate businesses must purchase their own licenses, even when working alongside or collaborating with the original purchaser.

B. Single Studio Businesses

A business operating from one permanent studio or storefront receives a commercial-use license for that specific studio location.

The license permits:

  • Unlimited paid events at the licensed studio.

  • Unlimited off-site events conducted by the licensed studio business.

  • Use by employees and instructors conducting events on behalf of the licensed studio.

One license covers one permanent studio location and its associated off-site events.

C. Multiple Studio Locations & Franchises

Businesses operating multiple permanent studio or storefront locations must purchase a separate commercial-use license for each location where the materials will be used.

This requirement applies regardless of whether the locations:

  • Share the same owner.

  • Operate under the same business name.

  • Are owned by the same parent company.

  • Are operated by the same franchise owner.

  • Share employees, management, or administrative resources.

Example: A franchise owner operating three studio locations must purchase three commercial-use licenses to use the materials at all four locations.

A single-location license does not authorize use or distribution of the materials at additional permanent studio or franchise locations.

D. Multi-Location Licensing

Discounted licensing packages may be available for businesses operating multiple permanent locations.

Businesses interested in purchasing licenses for multiple locations should contact Rare Bird Art Studio before distributing or using the materials at additional locations.

4. IMPORTANT: YOUR LICENSE IS FOR USE, NOT RESALE

Your purchase gives you permission to use the materials commercially to earn revenue by hosting creative events.

It does not transfer ownership or copyright of the materials to you.

You may sell the EXPERIENCE. You may not sell the MATERIALS.

For example:

You may purchase a Murder Mystery Paint Party package, advertise an event through your licensed business, charge guests to attend, and use the included stories, characters, clues, host materials, painting resources, and instructions during the event.

You may not take those same materials, change the title, rewrite portions of the story, add your logo, repackage the contents, or distribute or sell them as your own product.

The same restrictions apply to all commercial-use products, including workshop manuals, event packets, trivia games, instructional resources, and other downloadable materials.

5. LICENSE IS NON-TRANSFERABLE

This license is granted only to the original purchasing business and is limited to the business operations or locations expressly permitted under Section 3.

Purchasing this product does not give you the right to transfer, assign, share, sublicense, or extend your license to another individual, independently operated business, or additional studio location.

If another business or studio location wishes to use these materials, it must obtain its own commercial-use license.
